Warden Optometry: TEXT MESSAGING TERMS OF USE

By opting in to or using a “Text Message Service” (as defined below) provided by Warden Optometry, you agree to these Terms & Conditions. [IF APPLICABLE: THIS AGREEMENT IS GOVERNED BY BINDING ARBITRATION AND INCLUDES A WAIVER OF CLASS ACTION RIGHTS, AS EXPLAINED BELOW.]

This agreement is between you and Warden Optometry. All references to “Warden Optometry,” “we,” “our,” or “us” refer to Warden Optometry, 30 Gibson Drive Unit 101, Markham ON L3R 2S3

DEFINITIONS

“Opting In,” “Opt In,” and “Opt-In” refer to requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, responding to, or otherwise consenting to receive one or more text messages.

“Text Message Service” includes any arrangement or situation in which we send one or more messages addressed to your mobile phone number, including text messages (such as SMS, MMS, or successor protocols or technologies).

CONSENTING TO TEXT MESSAGING

By consenting to receive text messages from us, you agreed to these Text Messaging Terms and Conditions, as well as our Privacy Policy.

WARDEN OPTOMETRY TEXT MESSAGE SERVICE PRIVACY POLICY

We value your privacy and use the information you provide through this service solely to send your mobile messages and respond to you. This may include sharing information with referring doctors, lawyers, and phone companies that assist with message delivery. We do not share your mobile information with third parties or affiliates for marketing or promotional purposes. Additionally, text messaging opt-in data and consent information will never be shared with third parties. However, we reserve the right to disclose information as required by law, regulation, or government request, to limit liability, or to protect our rights or property. This Text Message Service Privacy Policy applies specifically to your use of the Text Message Service and does not alter our general Privacy Policy, which remains applicable in other situations and is incorporated by reference.

COSTS OF TEXT MESSAGES

We do not charge you for messages sent or received through this text message service. However, message and data rates may apply based on your wireless or other service provider’s plan, and you may incur charges from your carrier or provider.

FREQUENCY OF TEXT MESSAGES

This Text Messaging Service is designed for direct, person-to-person conversations between you and our employees. We may send you an initial message with information about the service. Afterwards, the number of text messages you receive will depend on your appointments and requests that prompt additional messages from us.

OPTING OUT OF TEXT MESSAGES

If you no longer want to receive text messages, you may reply to any text message with STOP. As a person-to-person communication service, opt-out requests are specific to each conversation between you and one of our employees. After unsubscribing, we may send you confirmation of your opt-out via text message.
